Vacating a Public Easement or Right-of-Way

 

Occasionally, property owners wish to vacate an unused utility easement or public right-of-way. Vacating a utility easement requires the review and approval of all agencies that benefit from the easement before it can be vacated. This can be a long and time-consuming process. For right-of-way vacation, the property owner must receive approval from either the Larimer County Engineering Department or the Town of Estes Park Public Works Committee. Approval of the vacation of a right-of-way is very rare.

If the public easement or right-of-way has been formally dedicated to the public and accepted by the Larimer County Board of County Commissioners or Estes Park Town Board of Trustees, a formal review and vacation process is required. Approval of the County Commissioners (for properties in unincorporated Larimer County) or the Town Board (for properties within Town limits) must be obtained. Requests for an easement or right-of-way vacation within Estes Park town limits must be presented to the Public Works Committee prior to being heard by the Town Board.

If you decide to pursue the vacation, you must schedule a formal pre-application conference with a Planner prior to submitting your application.
